Terms of Service

By purchasing the Artist’s services, the Client automatically agrees to the following terms and conditions. The following terms and conditions relate to Commissions for Personal use only. To enquire about Commissions for Commercial use, email [email protected].The Artist has the right to refuse a commission without a reason. Commissions are delivered in digital form only. No shipping of physical goods included. Commissions will be completed in the style and quality seen in the Artist’s online portfolios.COMMISSION AGREEMENT
The Commission Agreement is the discussion, documented via email or private message in which the Artist and Client agree to the Commission subject matter, price, conditions of payment, point in time the Artist is expected to commence/complete work, and – if applicable – the Commission deadline.PAYMENT
All transactions are via PayPal invoice(s) sent to the Client’s email address. All prices are expressed in Australian Dollars (AUD). The Client can choose to pay full price upfront, or a 50% deposit before the Artist commences work and remainder 50% before final delivery of Commission.PROCEDURE
After payment is received, the Artist will begin the Commission. The Client agrees to remain in contact with the Artist for the entirety of the Commission process. Work in progress images will be provided during the sketch, linework and colouring stages of the Commission, allowing the Client opportunities to provide feedback and request changes throughout. Requests for major changes to design beyond the linework stage will incur an extra fee. Once final details of the Commission are complete, a watermarked image of the piece will be provided to the Client for confirmation of final delivery. This is the final opportunity for the Client to request changes. The final piece will be delivered to the Client in the form of PNG via a shareable link. Full resolution progress images and working files will not be shared with the Client at any point.REFUNDS
Once the Artist starts the Commission, a full refund cannot be made. Refunds are negotiable depending on the state of the Commission. If the Artist has not started the Commission, the Client can ask for a full refund. Depending on if the Artist is in the sketch, line art, or colouring stage of the Commission, a 75%, 50% and 25% refund can be given respectively. If any unforeseen event or circumstance interferes with the timely completion of the Commission, the Artist will notify the Client and promptly issue a full refund.ARTIST’S RIGHTS AND USAGE
The Artist retains all copyrights over the Commissioned work, which includes but is not limited to the right to sell, distribute, reproduce or use the image and any work in progress material as a sample for sales/self-promotion.CLIENT’S RIGHTS AND USAGE
Personal Commissions ordered from the Artist are for Personal use only and cannot be used in any shape or form for commercial reasons. The Client cannot claim the work to be their own. The Client cannot distribute, reproduce, or otherwise profit from the Commission. The Client cannot edit, alter or trace the Commission without the Artist’s expressed written permission. No Commission can be displayed without notifying the Artist first. The Client may display the Commission on online profiles as long as the Artist’s name “Emily White” is prominently displayed along with a link to instagram.com/emwhitestudio or tagging “@emwhitestudio” if posted on any of the Artist’s associated profiles: Instagram, Twitter, ArtStation, Pinterest.
